Terms of Service

1.Acceptance of Terms

By accessing or using WarmupSleuth ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service. By creating an account, you represent that you are at least 18 years of age and have the legal authority to enter into these Terms.

2.Description of Service

WarmupSleuth is an email warmup and deliverability optimization platform. The Service provides automated email warmup through a network of verified senders, AI-powered email generation, reputation monitoring, DNS health checks, and deliverability analytics. We offer multiple subscription tiers (Free, Starter, Pro, Max, and Enterprise) with varying feature sets and mailbox limits. The Service is accessible via web application, mobile application, and REST API.

3.Account Registration

To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, including your password and any two-factor authentication (2FA) secrets. You agree to notify us immediately of any unauthorized access to your account. You are responsible for all activities that occur under your account. WarmupSleuth reserves the right to suspend or terminate accounts that provide false or misleading information.

4.Acceptable Use Policy

You agree to use the Service only for its intended purpose: improving the deliverability and sender reputation of legitimate email accounts. All email activity conducted through the Service must comply with applicable laws and regulations, including but not limited to the CAN-SPAM Act (United States), the General Data Protection Regulation (GDPR, European Union), and the Canadian Anti-Spam Legislation (CASL). You must ensure that any mailbox connected to the Service is owned or authorized by you.

5.Prohibited Activities

• Sending spam, phishing, or bulk unsolicited commercial email outside of the warmup process
• Using the Service to warm up mailboxes intended for fraudulent, deceptive, or illegal purposes
• Attempting to manipulate, reverse-engineer, or abuse the warmup network or reputation scoring algorithms
• Sharing account credentials with unauthorized third parties
• Connecting mailboxes that you do not own or have explicit authorization to manage
• Circumventing rate limits, plan restrictions, or security measures
• Using the Service to harvest email addresses or personal data
• Interfering with or disrupting the integrity of the Service or its infrastructure

6.Payment & Billing

Paid subscriptions are billed on a monthly or yearly basis through Stripe, our third-party payment processor. All fees are non-refundable except as required by applicable law. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. WarmupSleuth reserves the right to modify pricing with 30 days' notice to active subscribers. Failed payments may result in suspension of Service access. Free plan users are not required to provide payment information.

7.Intellectual Property

The Service, including its original content, features, functionality, branding, and underlying technology, is and remains the exclusive property of WarmupSleuth and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. Your use of the Service does not grant you any ownership rights in the platform or its content.

8.Data Privacy & Security

We take the security of your data seriously. Email credentials are encrypted using AES-256-GCM, passwords are hashed with Argon2id, and all communications are secured with TLS 1.3 in production. We process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR. You retain ownership of all data you provide to the Service. We will not sell your data to third parties.

9.Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. WarmupSleuth does not guarantee specific deliverability rates, inbox placement percentages, or sender reputation scores. Email deliverability depends on numerous factors outside our control, including recipient server policies, content quality, and domain reputation history. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10.Limitation of Liability

To the maximum extent permitted by applicable law, WarmupSleuth, its directors, employees, partners, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Service; (b) any unauthorized access to your data; (c) any interruption or cessation of the Service; or (d) any third-party conduct on the Service. Our total aggregate liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11.Indemnification

You agree to indemnify, defend, and hold harmless WarmupSleuth and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you transmit through the Service.

12.Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may request deletion of your account and associated data in accordance with our Privacy Policy and applicable data protection laws. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnity, and limitations of liability.

13.Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which WarmupSleuth operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules. You agree to submit to the personal jurisdiction of the courts located within the governing jurisdiction.

14.Changes to Terms

WarmupSleuth reserves the right to modify or replace these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service at least 30 days before they take effect. Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the revised Terms, you must discontinue use of the Service.
